- FlyTrap foto, LLC, also doing business as Potter’s Clay foto, and hereinafter referred to as “Potter’s Clay”) uses customer personal data (e.g. form of address, name, address, email, telephone number, fax number, bank account, credit card data) in accordance with all applicable federal and North Carolina state laws including but not limited to the North Carolina Identity Theft Protection Act, N.C. Gen. Stat. § 75-60 et al. All information submitted to Potter’s Clay that is considered personal data will be used, stored, and deleted strictly in compliance with all applicable laws.
- The customer’s personal data and images are used exclusively for the execution of contracts, and the performance of services between Potter’s Clay and its customers..
- The personal data of the customer transferred to Potter’s Clay will not be sold, transferred or available for third persons without the prior written consent of the customer, except for as otherwise stated in the Terms and Conditions Agreement or unless otherwise permitted or required to do so under any applicable law.
- The customer’s personal data will at all times remain confidential and provided only to Potter’s Clay’s authorized representatives who have been properly trained to maintain compliance with all applicable privacy laws. Potter’s Clay will take all reasonable measures to protect personal data from unauthorized disclosure, and will immediately comply with all notification requirements in the event that personal data is compromised.
- Potter’s Clay will delete all customer personal data in accordance with the North Carolina Identity Theft Protection Act and any other applicable law, which means in the event that Potter’s Clay disgards personal data, Potter’s Clay will shred all printed materials or otherwise render it practically unreadable, and will use electronic mechanisms to delete all electronic materials as required by law. If Potter’s Clay is required by law to retain any customer data, the data will be stored in compliance with all applicable laws, but will not be available for further use.
- Potter’s Clay will delete all personal information upon receipt of such written request from the personal information owner in accordance with the terms of this Policy. The deletion will occur in a reasonable business timeframe. Potter’s Clay will provide notice to the personal information owner that the personal data has been deleted.
